The DOL’s suit is based on the unfavorable disparity between the number of “qualified” Asian applicants for 3 engineering roles between 2010 and 2011 and the number of resulting Asian hires. Using referrals as a hiring channel is an extremely common practice, with the rationale being that it’s a reliable source of high-quality candidates.
